These general terms and conditions of sale (hereinafter GTCS) apply to all bookings made within the Résidence Paris-Asnières and regardless of the sales channel used.
ARTICLE 1 – BOOKING
The reservation is made by email or via our website. It becomes definitive only after the receipt by customer of a written confirmation by email from the Résidence Paris-Asnières. In the case of an online reservation, on the website www.residence-paris-asnieres.com the acknowledgment of receipt of the booking by email summarizes the contract offer, services reserved, prices, conditions of sale accepted by the customer relating to the rate selected, date of reservation, information relating to the after-sales service, and the address of the hotel vendor’s premises to which the customer should send any complaints.
Reservations are personal and can in no case be transferred to a third party, whether free, at a cost, or for commercial purposes. As consumers, customers have specific rights, which would be called into question in the event of the services reserved being used for the purpose of their commercial, industrial, business, professional or agricultural activities. The Résidence Paris-Asnières preserve the right to refuse access to the apartment that would have been reserved for the benefit of a minor under 18 years of age not accompanied by its legal administrators.
ARTICLE 2 – GUARANTEES
To be firm and final all reservations must be guaranteed with a valid credit card number since the beginning to the end of the stay and also:
– a credit card debit of the price of the first night, for stays between 1 and 8 nights
– a prepayment or a corresponding security deposit:
The guarantee can be used by the Résidence Paris-Asnières in case of non- payment by the customer of the amounts due to the Résidence Paris-Asnières, under the provision of accommodation and / or additional services consumed on site (breakfast, parking, etc.), possible damage in apartments or common spaces, or in case of theft in the Résidence Paris-Asnières. The credit card of the customer used for the payment and the guarantee of the stay, can be debited after customer’s departure, up to an estimate of restoration following the recognition of damage to the apartment occupied by the customer.
Failing compliance with these terms, the reservation will not be guaranteed.
The credit card used at the reservation and valid identity documents must be presented on arrival. Otherwise, access to the appartment may be refused by the Résidence Paris-Asnières.
For stays longer than 28 nights, a seasonal rental contract will be established between the Résidence Paris-Asnières and the occupant at check in time. The occupant must provide the following documents.
– 3 latest pay slips, the last tax notice, proof of address, bank account identity, a copy of valid identity document and a bank guarantee evidenced by a credit card valid until the end of the stay. The booking will not be guaranteed if all the documentation is not submitted at the time of signing the rental contract.
In any case, the client will not be able to make rented places his main residence, whether for professional reasons, or for family or medical reasons. The client agrees to have, for the duration of the lease, an effective principal residence.
ARTICLE 3 – PAYMENT TERMS
For stays lasting between 1 and 28 nights, the balance should be settled directly at hotel upon arrival, eventually the deposit will be deducted from the total amount for stays lasting longer than 8 nights. For stays of more than 28 nights the invoices will be issued and presented monthly and payable in advance. In case that the stay is carried out by a third party, the resident will remain jointly responsible for the payments as well as the respect of the charges and conditions. Payment for all optional services will be required on presentation of the corresponding invoice.
Accepted methods of payment: credit card (VISA, Mastercard, AMEX) bank transfer or cash (within the legal limits). Checks are not accepted for stays shorter than 90 nights.
Late payment: In case of breach of the payment deadlines, the Résidence Paris-Asnières may apply late payment penalties that will be due the day after the due date of the invoice at the rate of 15% per year, applied to the amount inclusive of VAT. A fixed penalty equal to 15% of the sums due will also be payable in the event of litigation recovery. In case of unpaid balance by the resident, the Résidence Paris-Asnières reserves the right to debit his credit card for the amount remaining due. Moreover, in case of late payment, the Résidence Paris-Asnières reserves the right to interrupt the stay of the customer.
ARTICLE 4 – RATES
The prices include all charges (water, electricity, heating) and include the renting of the apartment as well as the services defined at the time of the reservation. They do not include the taxes payable for each person occupying the apartment and payable on the day of arrival and optional services such as breakfast. The prices are flexible and variable in application of different criteria such as the date of reservation, length of stay, category of apartment, additional services requested. The prices are per apartment per night regardless of the number of people occupying the apartment (within the maximum allowed).
Household: Prices higher for a stay of 7 days or longer include a weekly cleaning which consists of the cleaning of the apartment (excluding dishes) and the change of bed linen and towels. Prices for stays shorter than 7 days do not include the cleaning service. The service can be requested at the reception and will be charged extra.
The Résidence Paris-Asnières reserves the right to modify the rates in the event of a legislative change likely to cause a variation of the prices (modification of the rate of VAT in force, introduction of a new tax …). For stays 29 days or longer an exit cleaning will be charged.
Child Policy: Accommodation is free for children under 16 staying in the apartment of his parents and must be mentioned at the time of booking. Babies kits can be booked in advance, directly at the reception (baby chair + cot), but their availability is not guaranteed.
ARTICLE 5 – CANCELLATION – CHANGE OF BOOKING
Any cancellation must be notified in writing by email to the Résidence Paris-Asnières. Cancellation is free of charge:
– up to three (3) days before arrival for stays between 1 and 89 nights,
– up to seven (7) days prior to 12 noon, for any stay over 90 nights.
Beyond these deadlines and in case of no show, the following cancellation fees will be applied and deducted from the customer’s credit card:
– the price of 1 night at the booked rate, for stays between 1 and 89 nights
– the price of 3 nights at the booked rate for any stay over 90 nights
Given the gradual reduction of tariffs linked to the length of stay, whether the partial cancellation of the booking corresponds to a change in the length of stay, the latter is likely to generate a rate change. In the case where the stay is shorter than that originally booked, the rate change is retroactive to the day of arrival.
In the case of a longer period of stay, the confirmation will be subject to the acceptance of the Résidence Paris-Asnières and the advance payment of the extra nights. The rate of change, if any, will be applied from the date of announcement of the extension of stay for the extra night (s). The rate change will not be retroactive.
ARTICLE 6 – RESERVATIONS NOT MODIFIABLE – NOT REFUNDABLE
Some of our booking offers are called NON-REFUNDABLE. For these stays, the following conditions and terms cancel and replace the cancellation and modification conditions and terms mentioned above.
Prepayment of the total amount of the stay: all reservations must be accompanied by the payment of 100% of the total price of the stay. Otherwise, the reservation will not be guaranteed.
Given the preferential rate granted by the Résidence Paris-Asnières as part of this offer, the reserved stays are neither exchangeable nor refundable or modifiable. No request for modification or cancellation will not be taken into account. Regardless of the date the reservation is cancelled, an allowance equal to 100% of the total amount of the stay will be retained. The non-consumption of optional services eventually booked and invoiced not give rise to any refund. No show results in the deduction of a legal indemnity equal to 100% of total stay.
ARTICLE 7 – ARRIVAL AND DEPARTURE
Key hand over is from 15:00 on the day of arrival, conditioned by the presentation of the credit card used on booking and a valid ID. The keys are returned before 10:00 am the day of your departure. Beyond that, an additional night will be charged to the customer. These times are indicative and may be different for certain periods. It is also possible to make a late check out (up 14 H) for an extra fee.
ARTICLE 8 – OCCUPANCY
An apartment is provided for a fixed number of occupants to accommodation and cannot in any case be inhabited by a greater number of people. All children 2 years and older are considered as a separate person and are included in the base occupancy of the apartment. The Résidence Paris-Asnières informs you that it is not possible to add extra beds in the apartments.
ARTICLE 9 – PERSONAL DATA
The personal data given during the booking procedure are collected for purposes of commercial management, billing, payment of commercial statistics and satisfaction surveys based on a CNIL authorization. In accordance with the legal provisions, you have a right of access, interrogation, rectification, opposition to the Résidence Paris-Asnières as well as the right to define guidelines for the processing of your data after your death that you can exercise by writing at the Residence Paris Asnières 7, rue General Mangin 92600 ASNIERES SUR SEINE.
ARTICLE 10 – RULES OF PROCEDURE
A set of rules is posted in the Résidence Paris-Asnières and put at the disposal of the client in the welcome notebook in each apartment. Each occupant is presumed to have taken cognizance of it. The occupant agrees to keep the movable property made available in the apartment in good condition and will have to declare upon receipt any defect or malfunction. We remind you that the omission of personal belongings inside the apartment when you leave do not engage the responsibility of the Résidence Paris-Asnières. The Résidence Paris-Asnières preserves the right to enter the apartments to achieve household, monitor the general condition and enforce the security conditions.
The Résidence Paris-Asnières offers guests an internet access via WIFI. The Customer agrees that IT resources made available by the Résidence Paris-Asnières are in no way used for reproduction, representation, making available or communication to the public of works or objects protected by copyright or by a neighbouring right, such as texts, images, photographs, musical works, audio-visual works, software and video games, without the authorization of the holders of the rights provided for in books I and II of the Intellectual Property Code when this authorization is required.
The Customer is required to comply with the security policy of the internet access provider of the Résidence Paris-Asnières, including the rules of use of the means of security implemented in order to prevent the illicit use of computer resources [or other name used in the company’s IT charter], and to refrain from any act that undermines the effectiveness of these means. If the Customer does not comply with the above obligations, it might be accused copyright infringement (Article L.335-3 of the Code of Intellectual Property), fined 300,000 euros and 3 years of imprisonment.
In the event of breach by the occupant of the obligation’s incumbent on him under the present conditions, in particular the non-observance of the rules of procedure, the Résidence Paris-Asnières reserves the right to suspend all services and to interrupt the occupant’s stay.
ARTICLE 11 – LIABILITY – APPLICABLE REGULATIONS
The operator cannot be held liable in case of theft or damage to personal effects both in the apartments and in the common premises and annexes of the residence. The provisions of articles 1952 and following of the Civil Code relating to hoteliers are not applicable. The operator has taken out insurance to guarantee the building as well as the furniture and equipment of the apartments with waiver of any recourse against the occupants.
The occupant can not avail himself of the legal provisions applicable to residential leases, particularly as regards the maintenance of the premises. The occupant agrees not to elect domicile at the address of the establishment, nor in the fiscal, professional or to lend, sublet, for any reason whatsoever, the apartment to a third party.
Under current regulations the client may be asked upon arrival to complete a police form. In this case, the customer will be asked to present an ID in order to check if it must complete or not the police card.
The pictures presented on the website are not contractual. Even if an effort is made to ensure that the pictures, other graphic representations and texts reproduced to illustrate the apartments on the website give as accurate overview as possible of the accommodation services offered, variations may occur, in particular due to the change of furniture or possible renovations. The customer cannot have any claim for this fact.
ARTICLE 12 – DELAYMENT
In case of exceptional event or impossibility to put the apartment at your disposal or in case of force majeure, the Résidence Paris-Asnières can offer you a dislodgement, for all or part of the duration of your stay, in a hotel equivalent category, for services of the same nature and subject to your prior agreement. Any additional cost will be carried by the Résidence Paris-Asnières.
ARTICLE 13 – CRIMINAL CLAUSE
In the case where the customer retains the enjoyment of his apartment beyond the contractual end of stay or the date of termination, he must pay, in addition to the daily fee (reference price) compensation of € 200 per day delay until his actual departure.
ARTICLE 14 – AFTER SALE
Our team is at your disposal during your stay to respond to your complaints, resolve any malfunctions found and allow you to enjoy your stay. You should contact them for any request.
Any claim after your stay within the limit of one month after the end of the stay, should be sent within registered letter with return receipt to the Résidence Paris Asnières indicating the name of the person reserved the stay, the number of the reservation, the place and dates of your stay as well as the type of apartment so as to facilitate the treatment of the file.
In case of dispute the parties agree to settle their dispute by mediation and declare to adhere to the mediation rules of the CMAP (PARIS Mediation and Arbitration Center) 39, av. F Roosevelt 75008 PARIS – consumer@cma.p.fr.
ARTICLE 15 – OPPOSABILITY OF TERMS
Registration for one of our stays implies the acceptance of our Terms and Conditions. To know the applicable conditions and in particular the conditions of reservation, payment, modification and cancellation, please see the conditions online at www.residence-paris-asnieres.com. The said GTCS apply for the duration of their posting on the site www.residence-paris-asnieres.com. and may be modified and / or supplemented at any time by the Résidence Paris-Asnières, which will put online, in this case, the new version of the special conditions of sale. As soon as it is posted online, the new version of the special conditions for internet sales will apply automatically for all customers.
The booking of a stay with the Résidence Paris-Asnières regardless of the reservation channel implies the acceptance of these Terms.
Any reservation via the site www.residence-paris-asnieres.com or directly made to the Residence Paris-Asnières supposes the consultation and the complete and unconditional acceptance of the GTCS and the conditions of sale of the reserved rate. The agreement of the customer concerning the GTCS and the conditions of sale of the reserved rate intervenes during the reservation. No reservation is possible without this agreement. The customer can save and edit the GTC using the standard features of his browser or computer. For any direct reservation, the GTCS will be sent to the customer from the first email of the Résidence Paris-Asnières.
If the GTCS are in contradiction with the special conditions of a rate (non-modifiable, non-refundable public rates) or a contract (Company, Leisure contracts, etc.), the latter shall prevail.
