General Conditions Of Stay

Article 1 – Legal Contract

The present contract is of a commercial nature according to the laws concerning tourist residences. The rent is concluded for a milited time. The resident cannot in any case prevail of the legal dispositions applicable in the matter of leases of buildings, in particular as to the maintenance of the premises or to the motivations of the rupture of the contract by the owner of the residence. The resident has declared that the apartment or apartments at his disposition would not constitute under any circumstances his main residence. Under the terms of the contract the owner maintains permanent access to the apartment to inspect the premises.

Article 2 – Reservation

Reservation is made by reservation slip with a deposit and is only definitive after confirmation by the Résidence Paris-Asnières and after the payment of a deposit by credit card valid or bank transfer. The deposit must be made in the 5 days following the reservation. After this deadline , the reservation will be cancelled . In case of cancellation, the deposit will be retained as specified in article 8.

Article 3 – Terms of payment

Invoices must be paid immediately on presentation. On the day of arrival, the client have to pay their entire stay . However in the case of stays longer than 30 nights, the invoices will be issued and presented monthly and are to be paid in advance. In cases where it has been agreed that a third party will pay for the client’s stay, the client will remain personally responsible for payment in question. Payment for optional services must be paid on presentation of the corresponding invoice. If invoices remain unpaid on the due dates, the Residence Paris Asnières shall be entitled to a monthly interest of 1,5 %. In cases of an outstanding balance remaining unpaid on the resident on the resident’s check-out date, the residence reserves the right to charge his credit card for the outstanding balance.

Article 4 – Rates

Rates include all taxes and just cover the provision of accommodations. They do not include the local city tax or optional services. They take into account the initial stay.

Article 5 – Securite deposit

Upon arrival, the resident must pay a security deposit. On the resident’s departure, an appointment will be taken for an inventory of fixtures..The deposit cannot, in any case , be charged on to the daily or monthly price of stay.The deposit paid is restored after payment of all invoices and the closing of the telephone account. In the event of dispute, the deposit will be restored at the conclusion of mediation or, failing this of a court order.

Article 6 – Check in and check out

Keys are handed over after 3pm on the check –in day. These keys are to be returned before 10am on the check-out day. In the absence of a written observation formulated on entry, the apartment is presumed to be in a good state, (article 1731 of the Civil code) with a complete inventory. On the resident’s departure, an appointment will be taken for an inventory of fixtures. Cleaning on leaving is billed to the client according to the indicated rate. The tenant »s repairs, the deteriorated equipment and objects are billed according to a scale available to the reception. The Résidence Paris Asnières reserves the right to enter the premises rented for purposes of maintenance or safety.

Article 7- Changes to the length of stay

Accommodation contracts are drawn up for the fixed duration mentioned. The right of stay of the resident automatically ends on the expiry of this duration. Subject to availability a stay can be extended without any obligation to retain the same apartment or the same price. In the event of an accepted extension and the application of new price will start on the first day of extension . In the event of an early departure , the applicable price will be that corresponding to the periode thus cut short. Any price alteration linked with an early departure will be applied retroactively to the client’s account as from the date of his arrival. In case of redcution of the duration of stay, the resident has to respect an advance notice of 15 days. The rate of the stay will be recalculated according to its effective duration depending on the price lis of the residence.

Article 8 – Cancellation – No shows

All cancellations must be made to the Residence Paris Asnières in writing. We reimburse any payment made in the case of a reservation cancelled at least 8 days before arrival. Cancellation made less than 8 days before the date of arrival will result in retaining the deposit made.

Article 9 – Responsibility-insurance

The responsibility for the owner cannot be engaged in case of theft or of degradation of personal effects in the apartments, common and additional buildings of the residence. The provisions of articles 1952 and following of the Civil Code relative to hoteliers are not applicable.

Article 10 – Termination-Penalties – Non-renewal

This contract shall be legally terminated and informally, in case of failure by the resident to fulfil any of his, obligations, or behaving inappropriately in a way that disturbs the other occupants of the building. The resident will have to vacate the premises immediately and may be evicted if need be with the help of law enforcement authorities
